Custody and visit arrangements
In later years, there has been an increasing focus on children who are living with violence in the family. This has given rise to amendments to the Childrens Act, with the purpose of giving children better protection against violence and abuse.

Project description
The goal of this project is to investigate the impact that these amendments have made in terms of legal practice with regard to issues of custody and place of residence for children after divorce.
Any observable changes in legal practice will be explored on the basis of the rulings made by the Court of Appeal for the years 1998-2000, 2006-2007 and 2012, 2014 and 2015. For the years 1998-2000, a previous analysis of legal practices related to child custody is available (K. Skjørten: Forståelser av overgrep i barnefordelingssaker [Notions of abuse in child custody cases] Tidskrift for familierett, arverett og barnevernsrettslige spørsmål nr. 3-4/2004). The results from this study will now be compared to analyses of more recent material from the courts, after the latest amendments to the Children’s Act that are directly relevant to cases involving alleged abuse.
